Analog Mastering Studio is a service for improving the sound of sound recordings (Mastering), via data transfer to us or sent by post. More detailed information about the mastering process and the different services from Analog Mastering, please refer to our website: www.analog mastering.com and www.analog mastering.de. The transmitted audio data from the customer will be processed by Analog Mastering Studio (mastered) and the processed audio will be provided via download link in the requested format, like audio, DDP file or on storage media (CD-R). By submitting audio data and the associated service ordering a precontractual relationship occurs between the client and Analog Mastering, a definitive purchase agreement needs to be confirmed in written, electronic (eg. email) or verbal form. Exception: First-time customers that may have received a demo master (sample) from Analog Mastering Studio are free to withdraw from the pre-contractual obligation if not satisfied with the demo master. Demo master, also in extracts are intended solely for the evaluation of our services and excluded from any further use or disclosure, otherwise the obligation remains. Customers who take advantage of our services must be at least 16 years old and identify themselves with the correct specification of all required data.
The current price list for our service is available on www.analog-mastering.com. Calculations are made exclusively in Euro and are exemplarily shown in USD. Payments will be made without deductions by Paypal (to: studio@analog-mastering.com) or bank transfer to the specified account owner (Frank Marheineke, SWIFT: HELADEF1HAN, IBAN: DE20506500230112023833). All prices are subject to change. Analog Mastering Studio reserves the right to change prices and services without notice at any time. Already placed orders or closed framework agreements remain unaffected to changes and are based on the date of the order.
Transmitted audio data to Analog Mastering Studio is digitally stored indefinitely and all order-related data will be stored after the mastering process to a safe backup media - without prejudice. By using the eMastering service (also referred to as 'online mastering'), the customer will immediately receive a link for downloading the files upon completion of the processing. These provided files will be deleted from the distribution-platform/server latest in a week, at the earliest after downloading the Masters by the customer. A subsequent guaranteed delivery is not possible.
Analog Mastering Studio reserves the right to delete individual files or the releated directory at any time without prior notice, if a non-compliance with our terms and conditions, particularly the misuse of our services can be expected.
This website and all the services offered are to be accepted as seen. Analog Mastering expressly disclaims any liability for damages that may arise from the use of our services. Analog Mastering Studio disclaims all liability
for damages of your files and / or your computer system. This also applies to errors that can arise from the digital data transmission. All of Analog Mastering Studio master files are to check for bugs or errors by the customer after receipt, before publication or reproduction. Complaints must be reported within 3 working days to us. After this period Audiomaster are considered free of defects, processed and delivered according to contract. Analog Mastering Studio is expressly not liable for any damages to the customer resulting from the use of faulty audio master data.
Customer data will be treated confidentially and sensitively and will not be passed on to third parties. Throughout the contract all submitted original audio files (recordings) remain the customer's property. Analog Mastering Studio reserves ownership of the service delivered (Mastering) until the final and complete payment by the customer. All rights reserved.
You can revoke your contract explanation within two weeks without giving reasons in writing (eg letter, fax, e-mail). The time limit begins after receipt of this notice in written form, but not before the contract is concluded and also does not fulfill our obligations as per §312c Section 2 BGB in conjunction with §1 Sections 1, 2 and 4 BGB-InfoV. The revocation period is sufficient to send the cancellation. The revocation must be sent to: Frank Marheineke, Nibelungenallee 10, D-60318 Frankfurt. Obligations to reimburse payments must be made within 14 days. The time limit begins for you when you send your cancellation notice, and for us upon receipt. Special Notes: Your right of cancellation expires if your contractor has started the service with your consent before the cancellation period or you have arranged this yourself. End of withdrawal.
The name "Analog Mastering Studio" all image, text content, programming and graphical layout are protected by copyright. A publication or use through third parties without written approval from Frank Marheineke is generally prohibited. Copyright violations will be prosecuted.
Litigation, which are associated with Analog Mastering Studio will always be held at the site of Mainframe Analog Mastering. The entire contract is governed by German law. The venue is 6000 Frankfurt am Main, Germany. Analog Mastering Studio reserves the right to modify these Terms and Conditions at any time without notice, to expand or end the service entirely.
Upon fulfillment of the service through Analog Mastering Studio and complete payment by the customer, the custumer can reference to the our service for the respective titels processed as follows: "Mastered by Frank Marheineke at Analog Mastering Studio" and "www.analog-mastering.com" or "www.analog-mastering.de". Corresponding adjustment to other languages and analogous modification to fit the costumers layout is allowed.
If any provision of this contract or the terms and conditions be or become invalid or should the contract be incomplete, the remaining clauses of the contract or the terms and conditions remain valid and unaffected. The ineffective regulation is replaced by a provision that the intent and purpose of the ineffective provision in a legal manner on the next. The same applies to possible gaps in the contract.
